Access to this information system (the "System") that stores, transmits, or processes Great American Insurance Company (hereafter referred to as "Company") information is restricted to persons who have received individual user identification names and passwords assigned by the manager of the System. To obtain access to the System you must first enter your user identification name and password and then indicate your agreement to the terms of use stated herein by clicking the "Agree" box below. Each time you enter your assigned user identification name ("User ID") and password ("Password") in the Login box and gain access to the System, you are agreeing to the Company's stated terms of use, which the Company may amend from time to time, and you (the "User") are acknowledging that your access to and use of the System is expressly conditioned upon your compliance with these stated terms of use: Company is the absolute owner of the System, User IDs and Passwords used to access the System. User's permitted use of an assigned User ID, Password and the System does not create or imply any lien, interest or right therein on the part of User. Company is the absolute owner of all data used and displayed on the System including, but not limited to, text, software, photographs, graphics, illustrations, logos and service marks. User agrees to use any information accessed via the System only for the purposes of administration and servicing of insurance policies written by the Company and / or its subsidiaries. User represents and warrants that the System will not be used for any purpose that is unlawful or prohibited by this Access Agreement. User acknowledges that the System includes proprietary and/or confidential information of the Company. User agrees to preserve and protect the confidentiality of such information. User further agrees to comply fully with all federal and state laws and regulations governing the collection and use of the non-public personal information including but not limited to, the Health Insurance Portability and Accountability Act and the Gramm-Leach-Bliley Act ("Privacy Laws"), of the customers and consumers of Company and / or its subsidiaries. User specifically agrees not to disclose any non-public personal information that User may obtain through access to the System, except as permitted by applicable Privacy Laws. Company has made every effort to ensure the accuracy of the information provided via the System, however, it does not warrant or guarantee the accuracy thereof. Company specifically disclaims any liability for any loss, damage or expense incurred by User as a result of (i) any actual or alleged mistakes, errors or omissions in the information or data supplied via the System, or (ii) any delays, interruptions or other problems interfering with delivery of the System or information stream or failure to provide the electronic access contemplated by the Access Agreement, whether resulting from the intentional or unintentional malfunction of the System or Company???s decision to discontinue providing the information through the internet or any other cause whatsoever. User agrees to indemnify and hold Company harmless from any loss, damage or expense, including attorney fees, incurred by Company as a result of (a) User's misuse of the User ID, Password or System, or (b) User's breach of any of the terms of this Access Agreement. User agrees to maintain the confidentiality of User???s Password and agrees to notify Company of a stolen Password or any unauthorized access to the System. Company reserves its right to terminate this Access Agreement and User???s access to the System, in whole or in part, at any time, with or without cause. COMPANY MAKES NO REPRESENTATION, WARRANTY, OR ASSURANCE UNDER THIS AGREEMENT AS TO THE ACCURACY, CONDITION. COMPLETENESS, MERCHANTABILITY, FITNESS FOR ANY PURPOSE, OR THE ABSENCE OF ANY CONFLICT OR INFRINGEMENT OF THE PATENTS, INTELLECTUAL PROPERTY, OR OTHER RIGHTS OF OTHER PARTIES AND DISCLAIMS ANY AND ALL LIABILITY THAT MAY BE BASED ON THE CONFIDENTIAL OR NON-PUBLIC PERSONAL INFORMATION, ERRORS THEREIN, OR OMISSIONS THEREFROM.
